深圳市2012年知识产权发展状况白皮书

  2012年,面对复杂严峻的外部环境和转型升级的内在压力,深圳市坚持以创新驱动发展,深入实施知识产权强市战略,以完善知识产权管理体制机制为契机,推动知识产权创造、运用、保护和管理再上新台阶,为深圳实现有质量的稳定增长、可持续的全面发展提供了有力支撑。

  一、实施知识产权强市战略,打造“深圳质量”

  (一)国家知识产权示范城市创建工作取得重大进展

  近年来,深圳大力实施知识产权强市战略,以战略实施促进国家知识产权示范城市创建,在知识产权创造、运用、保护和管理方面取得了显著成效。2012年4月25日,国家知识产权局田力普局长将第一块“国家知识产权示范城市”的牌子授予深圳市政府,广东省委常委、深圳市委书记王荣出席会议,与田力普局长共同为国家知识产权示范城市揭牌。为推进知识产权示范城市建设工作,发布《深圳市建设国家知识产权示范城市工作方案》,对深圳市今后三年的知识产权工作进行了细化,明确了各部门的分工职责以及深圳未来三年知识产权工作的发展目标,提出将深圳建设成为全国知识产权示范城市、商标战略实施示范城市以及版权示范城市,进一步开创了深圳市实施知识产权战略的新局面。

  (二)国家商标战略实施示范城市建设实现新突破

  实施商标战略示范城市创建工作以来,深圳充分发挥机构改革后专利、商标、版权职能统一的优势,围绕服务地方经济的中心任务,不断加大商标工作投入力度。通过建立科学高效的商标管理工作机制和商标公共服务平台,企业注册、运用、保护和管理商标的综合能力明显提升,商标的社会认知度有较大提高,商标战略实施取得明显成效。2012年,深圳的自主商标注册量高速增长,自主品牌不断壮大,市场影响力不断提升,企业争创驰名、著名商标的积极性越来越高,商标战略水平显著提升。商标已成为深圳转变经济发展方式、实现经济社会又好又快发展的重要因素和可靠动力。

  (三)知识产权体制机制进一步加强

  知识产权体制机制不断创新,2012年2月在深圳市场监督管理局加挂知识产权局牌子,进一步强化知识产权对经济社会发展的支撑引领作用,国家知识产权局对深圳体制方面的持续创新高度重视,田力普局长来深出席揭牌仪式。此外,高度重视发挥深圳市知识产权联席会议的平台作用,进一步加强跨部门知识产权协作机制。全年召开2次全体会议,5次重点成员单位联席会议,研究知识产权工作形势,完善行政执法部门与公安机关、司法机关协调配合的工作格局;在中国(深圳)国际文化产业博览交易会(文博会)、中国国际高新技术成果交易会(高交会)等重要展会和打击欺行霸市、打击制假售假、打击商业贿赂(“三打”)专项行动中,通过联合执法,形成知识产权保护合力。

  二、增强知识产权创造和运用能力,实现创新驱动发展

  (一)知识产权创造能力继续领跑全国

  发明专利申请量和拥有量纳入国家“十二五”规划、珠三角改革发展规划纲要,作为考核各级政府的重要指标。截至2012年底,深圳国内有效发明专利累计达52768件,专利密度为50件/万人,远远高出国家“十二五”规划2015年每万人3.3件的目标,高居全国榜首;中国驰名商标累计达103件,居全国副省级城市首位,成为全国首个驰名商标突破百件的副省级城市;有效注册商标累计达199863件,平均4.76个市场主体拥有一件注册商标,高于2011年5.03个市场主体拥有一件注册商标的水平。2012年,深圳每百万人国内发明专利申请量达2946件,超额完成广东省政府下达的2800件考核目标;专利合作条约(PCT)国际专利申请量8024件,连续九年居全国首位,占全国申请总量19926件的40.3%。中兴通讯股份有限公司的PCT国际专利申请量(3906件)继2011年之后再度蝉联全球冠军,领先第二的松下电器公司(2961件)近千件,华为技术有限公司以1801件位列全球第四;深圳光启高等理工研究院专利申请量占全球超材料领域的85%以上;华为技术有限公司、中兴通讯股份有限公司在LTE技术领域的基本专利占全球的1/5。

  (二)知识产权运用能力进一步增强

  2012年,全国发明专利授权量排名前十强企业中,深圳占5席,其中华为技术有限公司(2734件)、中兴通讯股份有限公司(2727件)、鸿富锦精密工业(深圳)有限公司(1099件)位列前三。一批中小知识产权企业崛起,成为深圳知识产权申请第二梯队。2012年深圳市全社会研发投入占GDP比重提高到3.81%,居全国领先水平,高新技术产品产值1.29万亿元,其中具有自主知识产权的达61%。深圳市企业主导或参与制定国际、国家和行业标准416项,其中国际标准137项。2012年,深圳华为技术有限公司、比亚迪股份有限公司、中兴通讯股份有限公司、腾讯科技(深圳)有限公司等企业获第十四届中国专利奖优秀奖15项,外观设计奖优秀奖4项;深圳广电集团、深圳报业集团获“广东省版权兴业示范基地”称号。

  (三)知识产权联盟集群效应显现

  2012年,进一步优化整合产业联盟成员知识产权和标准化资源,提高运用知识产权和共同抵御风险的能力。深圳市知识产权局印发了《深圳市知识产权专项资金管理办法——知识产权产业联盟建设项目资助操作规程》,将产业联盟项目纳入到知识产权专项资金的资助范围,推进知识产权联盟形成集群效应,开展协同创新。2012年度资助产业联盟项目2项共计60万元。深圳市知识产权局正式批复同意成立由深圳市中彩联科技有限公司、深圳创维-RGB电子有限公司、TCL集团股份有限公司、腾讯科技(深圳)有限公司等13家企业共同发起的“中国彩电专利联盟”,充分发挥了联盟在促进中国产业持续健康发展的重要作用。

  三、加大知识产权保护力度,营造良好法治化营商环境

  (一)集中开展知识产权专项行动

  2012年,为打击重点领域、重点地区、重点产品知识产权侵权违法行为,深圳市市场监督管理局(知识产权局)开展了知识产权执法维权“护航”专项行动、动漫产品市场专项整治行动、打击网络侵权盗版“剑网行动”、网络购物领域专项整治行动、手机及电子市场专项整治行动、打击非法印制卷烟商标标识专项行动等专项治理工作,集中捣毁了一批重点制假售假窝点,查处了一批重点案件,取得了良好效果。2012年,深圳市市场监督管理局(知识产权局)共办理专利案件110件,版权案件108件,商标案件903件。深圳市文体旅游局检查出版物经营场所9822家次,办理案件231件,收缴非法出版物7.28万件,货值705万元,移交公安机关刑事案件 34件39人。深圳海关共采取知识产权执法措施4800多批次,查获侵权货物3500万件,案值逾9800万元。全市公安机关共立重大制假售假案件1521件,破案1332件,刑拘1396人,逮捕903人,破案率达到87.57%。

  (二)继续加强知识产权司法保护力度

  2012年,全市检察机关共受理审查逮捕侵犯知识产权犯罪案件752件1222人,批捕647件952人;共受理起诉侵犯知识产权犯罪案件692件993人,起诉651件900人。全市两级法院受理知识产权司法案件10405件,同比增长39.53 %。结案9215件,同比增长41.87 %。其中,深圳市中级人民法院受理知识产权案件 3027件,结案2189件;福田区人民法院受理1559件,结案1467件;罗湖区人民法院受理1083件,结案1045件;南山区人民法院受理1077件,结案1051件;盐田区人民法院受理73件,结案73件;龙岗区人民法院受理1272件,结案1247件;宝安区人民法院受理2314件,结案2143件。

  (三)健全完善知识产权保护长效机制

  根据深圳市“两建”工作的总体部署,成立由深圳市市场监督管理局(知识产权局)牵头的知识产权保护综合监管分体系建设工作小组,制定《深圳市知识产权保护综合监管分体系建设实施方案(试行)》,从完善知识产权监管行政执法体系、加强重点地区重点行业知识产权监管、建立健全行政执法和刑事司法相衔接工作机制、创新源头监管机制、探索网络环境下知识产权保护方式方法、加快信息平台建设、提高知识产权服务水平、提升企业应对涉外知识产权纠纷能力、加大知识产权宣传力度等方面对知识产权保护长效机制提出了具体要求。2012年实现了市级党政机关、事业单位及部分企业的全面软件正版化,区级机关办公软件正版化。深圳市市场监督管理局(知识产权局)在专业市场试点推行知识产权授权经营制度,逐步实现市场监管关口前移;深圳市公安局不断加强与技侦、网监、警察公共关系处等警种的协同作战,进一步构建一体化侵犯知识产权犯罪防控体系;深圳市人民检察院制定出台《深圳市行政执法与刑事司法衔接工作实施办法》和《深圳市行政执法与刑事司法信息共享平台管理规定》,确立党委领导、政府负责、检察监督、覆盖全市的“两法”衔接格局;深圳市中级人民法院持续深入推进“三审合一”改革,基本确立符合知识产权审判特点和内在规律的审判体制。

  四、提升知识产权管理和服务水平,助推产业转型升级

  (一)知识产权管理政策体系不断完善

  深圳市人民政府出台《深圳市促进知识产权质押融资若干措施》,从机制、平台、评估、放贷、担保、交易、配套服务、推进保障等八个方面提出具体措施,切实解决中小企业融资难的问题,激发企业创新活力。为推动深圳版权产业健康发展,深圳市知识产权局研究制定《深圳市版权兴业示范基地管理指引》,加强版权兴业示范基地管理;制定《深圳市专利代理机构服务规范》并上升为地方标准,进一步规范专利代理机构发展。深圳市经济贸易和信息化委员会出台《关于加快工业设计业发展的若干措施》,加快工业设计品牌化、高端化、国际化发展;修订《深圳技术进步资金品牌培育资助操作规程》,提升深圳市产业品牌形象。深圳市国有资产监督管理委员会出台《对市属企业自主创新奖励扶持暂行办法》,切实加大自主创新引导扶持力度。

  (二)知识产权专项资金绩效明显

  深圳市知识产权局与深圳市财政委员会联合修订发布《深圳市知识产权专项资金管理办法》及包括专利申请资助、境外商标注册资助、计算机软件著作权登记申请资助等在内的9个操作规程,扩充专项资金的资助范围,2012年深圳市共投入知识产权专项资金2.08亿元。通过发挥财政资金的杠杆作用,2012年,深圳国内专利申请量73130件,同比增长15.13%;其中发明专利申请量31075件,同比增长7.81%,占申请总量的42.49%;国内专利授权量48662件,同比增长23.62%;其中发明专利授权13068件,同比增长10.50%,占授权总量的26.85%;商标申请量67888件,同比增长26.5%;计算机软件著作权登记12374件,同比增长29.86%,位居全国大中城市第三位,占广东省登记总量22128件的55.92%。培育新增深圳市知识产权优势企业20家;评选深圳市专利奖25项;资助知识产权分析预警及版权备案公共服务项目15项、知识产权联盟建设项目2项、宣传培训项目56项。

  (三)知识产权服务范围不断拓宽

  围绕加快转变经济发展方式的主线,充分发挥知识产权支撑作用,在继 2011年将深圳华大基因研究院和深圳光启高等理工研究院作为“定制式”服务的对象后,深圳市知识产权局2012年又制定了《为腾讯公司提供知识产权与标准化服务工作方案》,为腾讯科技(深圳)有限公司提供专利风险管控培训等“处方式”服务,不断拓宽服务的范围。经过近两年的探索实践,知识产权“定制式”服务取得良好成效。

  五、深化知识产权文化建设和合作交流,树立国际化创新城市良好形象

  (一)知识产权宣传工作成效显著

  利用“4.26”世界知识产权日、文化产业博览交易会、高新技术成果交易会、专利周、商标法颁布三十周年等重大活动,积极开展知识产权宣传工作。深圳市市场监督管理局(知识产权局)开通官方微博,不定期发布全市知识产权重大信息。深圳市人民检察院开展为期8个月的“保护知识产权 促进三打两建”系列活动,通过进企业宣讲、举办培训班、组织企业管理人员到深圳监狱开展警示教育活动等形式,加强知识产权刑事司法保护宣传。各区创新形式推动知识产权宣传,收效显著。福田区在华强北投放“培育知识产权文化、促进社会创新发展”的立柱广告、电子滚动屏;罗湖区在水贝黄金珠宝产业基地文化广场举行知识产权宣传咨询活动的同时,利用电子大屏幕播放知识产权宣传短片;南山区开展区优秀版权企业创新知识产权成果展等。继续通过“深圳知识产权”腾讯微博进行互动交流,引起高度关注,参与互动人数超过50万。持续开展“知识产权名人讲堂”和“知识产权鹏城论坛”品牌培训活动,2012年组织开展对知识产权管理人员、中介代理机构、企业的知识产权宣传培训超过56场/次,受训人数超4000人。

  (二)知识产权人才培养工作扎实推进

  继续与深圳市人力资源和社会保障局加强联系,开展2012年度知识产权职称评定工作,共有18人获得知识产权系列专业技术资格,其中副高级职称8人,中级职称8人,初级职称2人。继续与深圳大学合作办好知识产权学院,目标是要将知识产权学院打造成为培养知识产权专业人才的特色学院,为深圳知识产权事业的发展提供人才支撑。深圳市有6人入围首批全国知识产权领军人才。

  (三)不断加强知识产权的对外合作交流

  继续推动深港知识产权交流合作,组团到香港海关学习交流,合作推动知识产权保护和打击假冒伪劣行为,召开知识产权联席会议,探索建立深港知识产权合作统筹协调机制。接待日本株式会社、日本特许厅厅长一行、英国驻华使馆知识产权专员、美国贸易代表办公室官员等来访;与TORYBURCH(汤丽柏琦)、微软、SAP、华特Disney等知识产权权利人交流;为肯德基、比亚迪、迈瑞、华为、中兴、腾讯等公司知识产权维权提供服务。

  面向未来,深圳将紧紧围绕科学发展主题和加快转变经济发展方式主线,把创新发展、深圳质量贯穿于经济社会发展的全过程和各领域,大力发展战略性新兴产业,努力提升核心技术自主创新能力,按照国家知识产权战略的整体要求和部署,深入实施知识产权强市战略,进一步整合资源,完善体制机制和政策措施,不断提升知识产权工作水平,为全国知识产权事业发展,为提升深圳自主创新能力做出更大贡献。

  In 2012, in face of complicated and severe external environment and internal pressure of transformation and upgrading, Shenzhen persisted in innovation-driven development and further implemented the strategy of IPR. With perfection of IPR management system and mechanism at its turning point, Shenzhen realized a breakthrough in IPR creation, exploitation, protection and management, which is a strong assurance to bring about stable growth and sustainable integrated development.

  I. Implementing the IPR Strategy to Fortify Shenzhen Quality

  1. In recent years, Shenzhen has implemented the strategy of IPR vigorously to facilitate national IPR demonstration city construction and has achieved significant progress in IPR creation, utilization, protection and management. On Apr. 25, 2012, Mr. Tian Lipu, director of State Intellectual Property Office, endowed Shenzhen Municipal Government with the first nameplate of ‘National IPR Demonstration City’. On the same day, Mr. Wang Rong, Member of the Standing Committee of CPC Guangzhou Provincial Committee and Secretary of the Shenzhen Municipal Committee presented and unveiled the nameplate together with director Tian Lipu. In order to boost construction of IPR demonstration city, the Municipal Government of Shenzhen issued Work Program on Construction of National Intellectual Property Demonstration City of Shenzhen which refines IPR works of Shenzhen in the next three years based on its development goal, specifies division of responsibilities of all the government departments to establish Shenzhen into a demonstration city in intellectual property, trademark and copyright.

  2. A Breakthrough in Building a National Trademark Strategy Implementation Demonstration City

  Shenzhen has taken the integration advantages of patent, trademark and copyright acquired from institution reform, the city continues to intensify its input of trademark centered on the task of serving local economy to improve construction level of national trademark strategy demonstration city. By setting up a highly effective trademark management mechanism and providing public service platform, enterprises in Shenzhen has experienced a breakthrough in aspects of promoting trademark application for registration and fostering famous trademark etc. In 2012, the number of registered trademark in Shenzhen had seen a dramatic growth; proprietary brands attracted more attention as well as a huge increase in number. Enterprises in Shenzhen were striving to achieve recognition as national famous brands. Trademark strategy has become a core factor in transformation of the pattern of economic development in Shenzhen.

  3. Continuous Improvement in IPR Management System and Mechanism

  The city demonstrated continuous improvement in IPR management system and mechanism. In February of 2012, the Market Supervision Administration of Shenzhen Municipality has also been established as the Intellectual Property Office of Shenzhen, which further strengthened the leading role of IPR in social and economic development. Director Tian Lipu attended the Unveiling Ceremony in Shenzhen, which indicates that State Intellectual Property Office attached great importance to continuous structure reform in Shenzhen, at mean time, the Municipal Intellectual Property Joint Conference further strengthened trans-department cooperation mechanism of IPR. There were 2 plenary sessions and 5 important member joint conferences held to study IPR work situation, perfect work pattern of cooperation among administrative organization for law enforcement, public security organ and judicial offices; joint law enforcement actions were completed in the events of China (Shenzhen) International Cultural Industry Fair (ICIF), China High-tech Fair (CHTF) and other important exhibitions as well as special actions to combat attempts to monopolize the market, to manufacture and sell counterfeits and to commit commercial bribery.

  II.Increase IPR Creation and Exploitation Capacity to Realize Innovation-driven Development

  1. IPR Creation Capacity Took the Leading Role in China Continuously

  As an important index to assess governments at all levels, the number of patent applications and ownership has been incorporated into China’s 12th Five-year Plan and Pearl River Delta Reform and Development Program. By the end of 2012, valid domestic patents in Shenzhen accumulated to 52,768 with patent density of 50 per 10,000 persons, far above the goal set in 12th Five-year Plan of 3.3 per 10,000 persons in 2015, ranking the top in China; Shenzhen also stood the first place among sub-provincial cities with 103 famous trademarks and thus became the first sub-provincial city with over one hundred national famous trademarks; In addition, valid registered trademark totaled 199,863 which indicates that each 4.76 market entities owned one registered trademark, higher than the average number of 5.03 in 2011. In 2012, domestic patent applications (per 1 million persons) amounted to 2,946, outperforming the assessment goal of 2800 by Provincial Government in 2008. PCT (Patent Cooperation Treaty) international applications reached 8,024, ranking the top in China for nine consecutive years, accounting for 40.3% of the total domestic applications of 19,926. ZTE Communication Co., Ltd with 3,906 PCT international applications topped the world consecutively after 2011, approximately 1,000 more than Panasonic (of 2,961), which is in the second place; Huawei Technologies Co., Ltd ranked the fourth in the world with 1,801 PCT applications. Patent applications from Kuang-Chi Institute of Advanced Technology amounts to over 85% in the field of meta-material globally; basic patents from Huawei Technologies Co., Ltd and ZTE Communication Co., Ltd took up 1/5 in LTE technical field.

  2. IPR Exploitation Capacity Further Strengthened

  In 2012, five enterprises in Shenzhen were listed in the Top 10 Enterprises with the most invention patent grants, among which Huawei Technologies Co., Ltd (2,734), ZTE Communication Co., Ltd (2,727) and Hong Fu Jin Precision Industry (Shenzhen) Co., Ltd (1,099) took the first three places. A number of SMEs followed their leads and emerged as the second echelon contributes to Shenzhen IPR applications, relieving the bottleneck constraint of large enterprise IPR application only. Investment in R&D increased, accounting for 3.81% of GDP in 2012 and ranking the advance level nationally. During the same period, high-tech industrial output reached 1.29 trillion yuan, 61% of which had proprietary intellectual property rights. International, national and industrial standards formulation led by or participated by Shenzhen enterprises amounted to 416, with international standards of 137. In 2012, Shenzhen Huawei Technologies Co., Ltd, BYD Company Limited, ZTE Communications Co., Ltd, Tencent Technology (Shenzhen) Co., Ltd. etc., were granted with 15 Outstanding Awards, 4 Appearance Design Awards in the 14th China Patent Award; Shenzhen Media Group and Shenzhen Press Group were awarded the title of “Guangdong Copyright Industrial Demonstration Base”.

  3. Constellation Effects of IPR Alliance Proved

  The year 2012 witnessed further optimization and integration of IPR industry alliance members and standardized resources as well as an increased capacity to exploit IPR and withstand risks jointly. Shenzhen Intellectual Property Office printed and distributed Measures for Management of IPR Special Fund of Shenzhen-Operating Instructions for Grant of IPR Industry Alliance Construction Project which integrated industry alliance project into the scope granted by IPR special fund to promote constellation effect of IPR alliance and to develop collaborative innovation. In 2012, two industry alliance projects were funded, totaling 600,000 yuan. Shenzhen Intellectual Property Office officially approved the establishment of China Color TV Patent Alliance co-sponsored by 13 enterprises including Shenzhen CTU Hi-Tech Ltd., Shenzhen Skyworth-RGB Electronics Co., Ltd., TCL group Limited by Share Ltd, Tencent Technology (Shenzhen) Co., Ltd. which gives full play to the important role of alliance in promoting continuous, healthy development of Chinese industry.

  III. Strengthen IPR Protection Force to Improve Business Environment

  1. Unified Movements in IPR Special Actions

  In 2012, in order to combat IPR infringements of important fields, areas and products, the Market Supervision Administration of Shenzhen Municipality (Intellectual Property Office) launched a special ‘convoy’ action of IPR law enforcement. Another movement called ‘Jian Wang Action’ was launched against online IPR infringement and special campaigns in the animation product market, online shopping field and mobile phone & electronics market and against illegal print of trade mark labels for tobacco products etc. A number of key sites of manufacturing and selling counterfeits were destroyed; major cases were investigated and prosecuted during these actions which have produced good results. In 2012, Market Supervision Administration of Shenzhen Municipality (Intellectual Property Office) handled 110 patent cases in total, 108 copyright cases and 903 illegal trademark cases. Shenzhen Municipal Bureau of Culture, Sport and Tourism inspected 9822 business operation sites for publication, handled 231 administrative cases, captured over 728,000 illegal publications with value added up to 7050,000 yuan and transferred 34 criminal cases of 39 persons to public security organ. Shenzhen Customs took more than 4800 IPR law enforcement actions and seized more than 35 million infringements with value added up to over 98 million yuan. Public Security Organs in Shenzhen filed 1521 cases of manufacturing and selling counterfeits, solved 1332 cases, detained 1396 persons and arrested 903 suspects with detection rate of 87.57%.

  2. Continued to Strengthen IPR Juridical Protection

  In 2012, Procurator Organs in Shenzhen accepted investigation of 752 criminal cases of infringement upon IPR with 1,222 persons involved and ratified the arrest of 647 cases with 952 persons involved; they accepted lawsuit of 692 criminal cases of infringement upon IPR with 993 persons involved and prosecuted 651 cases with 900 persons involved. Courts at two levels in Shenzhen accepted 10,405 IPR juridical cases with a year-on-year growth of 39.53%, in which they closed 9,215 cases with a year-on-year growth of 41.87%. Therein, Municipal Intermediate People’s Court accepted 3,027 IPR cases and closed 2,189 cases; Futian District People’s Court accepted 1,559 cases and closed 1,467 cases; Luohu District People’s Court accepted 1,083 cases and closed 1,045 cases; Nanshan District People’s Court accepted 1,077 cases and closed 1,051 cases; Yantian District People’s Court accepted and closed 73 cases; Longgang District People’s Court accepted 1,272 cases and closed 1,247 cases; Bao’an District People’s Court accepted 2,314 cases and closed 2,143 cases.

  3.Long-term IPR Protection Mechanism Perfected

  Based on general deployment of the ‘two constructions’ work in Shenzhen, Market Supervision Administration of Shenzhen Municipality (Intellectual Property Office) took the lead to organize work team for supervision and multi-system construction of IPR protection and formulated Implementation Program on Comprehensive Supervision and Multi-system Construction of IPR Protection in Shenzhen (Trial Implementation). The program raises requirements in multiple aspects of perfecting IPR supervision and law enforcement system, strengthening IPR supervision in key areas and industries, building sound work mechanism combining administrative enforcement of law and criminal justice, innovating source supervision mechanism, exploring IPR protection methods in the internet environment, accelerating information platform construction, improving IPR service level and capacity of tackling foreign-related IPR disputes, intensifying IPR publicity as well as long-term mechanism of IPR protection. Software legalization was fully realized in municipal party and government offices, public institutions, partial enterprises as well as district organs in 2012. During the same period, Market Supervision of Shenzhen Municipality (Intellectual Property Office) launched pilot implementation of IPR authorized operation system in specialized markets, gradually promoting prevention of market supervision beforehand; Shenzhen Municipal Public Security Bureau continuously fortified the collaboration with Technical Surveillance, Network Monitor and Police Public Relations Bureau etc., to further construct integrated prevention and control system of IPR crime; People's Procuratorate of Shenzhen Municipality issued Implementation Measures for Connection of Administration Enforcement of Law and Criminal Justice in Shenzhen and Regulation on Information Sharing Platform Management of Administration Enforcement of Law and Criminal Justice which established the city-wide “Two Law” connection pattern for inspection and supervision led by party committee and charged by government; municipal Intermediate People’s Court further advanced reformation of “Three Trial in One”, therefore basically confirmed a trial system suitable for characteristics and internal law of IPR trails.

  IV. Enhanced IPR Management and Service Level to Boost Transformation of Industry

  1. IPR Policies Improved Continuously

  Shenzhen Municipal People’s Government issued Measures to Improve IPR Pledge Financing in Shenzhen which puts forward detailed measures of 8 aspects such as mechanism, platform, assessment, lending, guaranty, trade, supporting service and security promotion. The Measures is feasible to solve financing barriers for SMEs and stimulate innovation of enterprises. With the aim of boosting healthy development of Shenzhen copyright industry, Intellectual Property Office of Shenzhen Municipality studied and formulated Guidance on Copyright Industrial Demonstration Base Management in Shenzhen; in addition it also formulated Service Specification for Shenzhen Patent Agent which became a local standard to further normalize development of patent agent. Economy, Trade and Information Commission of Shenzhen Municipality issued Several Measures to Accelerate Development of Industrial Design to speed up the brandized, high-end oriented and internationalized progress for industrial design; it also revised Operation Instruction of Technical Progress Fund for Brand Cultivating in Shenzhen to promote industrial brand image. Shenzhen Assets Supervision and Administration Commission of the State Council issued Interim Procedures on Supporting and Encouraging Municipal Undertaking to Realize Independent Innovation to practically intensify guidance for independent innovation.

  2. IPR Funding Achieved Material Results

  In order to expand the scale of special funding, Market Supervision Administration of Shenzhen Municipality (Intellectual Property Office), together with Finance Commission of Shenzhen Municipality, revised Measures for Management of IPR Special Fund of Shenzhen in joint efforts as well as 9 operating instructions including patent application fund, overseas trademark registration fund, application for registration of computer software copyright etc.,. In 2012, the city’s budget of special IPR funds reached 230 million yuan. By bringing the leverage role of the financial fund into full play, the number of domestic patent application reached 73,130 with a year-on-year growth of 15.13%, in which 31,075 were invention patent applications with a year-on-year growth of 7.81%, taking up 42.49% of the total application number. The number of domestic patent grants amounted to 48,662 with a year-on-year growth of 23.62%, in which 13,068 were invention patent grants with a year-on-year growth of 10.50%, occupying 26.85% of the total grant amount. The number of trademark applications added up to 67,888 with a year-on-year growth of 26.5% while 12,374 computer software copyrights were registered with a year-on-year growth of 29.86%, ranking the third place among national large and middle-sized cities and accounting for 55.92% of total registration number 22,128 in Guangdong Province. Besides, Market Supervision Administration of Shenzhen Municipality cultivated an additional 20 enterprises with IPR advantages, awarded 25 patent prizes in Shenzhen, and funded 15 IPR warning analysis and public service projects of copyright reference, 2 IPR alliance building projects and 56 publicizing and training projects.

  3. IPR Service Scope Widened Significantly

  Centered on the theme of accelerating economic development, Market Supervision Administration of Shenzhen Municipality (Intellectual Property Office) launched ‘tailor-made’ service for Beijing Genomics Institute-Shenzhen and Shenzhen Kuang-Chi Institute of Advanced Technology in 2011 to give full play of supporting role of IPR. In the following year of 2012, it formulated Work Scheme on Providing IPR and Standardization Service with Tencent to supply ‘prescribed’ service and to broaden service scope. After two-year of exploration and practice, ‘tailor-made service’ of IPR acquired good results.

  V. Intensified IPR Culture Construction and Cooperation to Establish a Sound Image as Internationalized Creative City

  1. IPR Popularization Made Innumerable Achievements

  IPR popularization was actively carried out in every important event such as World Intellectual Property Day on “Apr., 26”, China (Shenzhen) International Cultural Industry Fair (ICIF), China High-tech Fair (CHTF), Patent Week and Trademark Festival. The Market Supervision Administration of Shenzhen Municipality (Intellectual Property Office) opened official micro-blog to irregularly publicize important IPR-related information of the city. People's Procuratorate of Shenzhen Municipality launched 8-month serial activities of “Protect Intellectual Property, Intensify 3 Crackdowns & 2 Constructions”, in which criminal justice protection of IPR was intensively publicized by preaching into enterprises, holding training class and organizing corporate supervisors to conduct warning education activities in Shenzhen prisons. Each district also promoted IPR popularization in innovative ways and made great progress. To be more specific, Futian District set column advertisements and electronic moving sign reading “Cultivate Intellectual Property Culture, Promote Innovative Social Development”; Luohu District organized IPR popularization consultancy activities and played IPR publicity Video by virtue of large electronic screen; Nanshan District exhibited results of excellent copyright enterprise and innovative IPR in the district etc., Highly-focused ‘Shenzhen IPR’ blog provided a platform for interaction with more than 500,000 participants. Continuous efforts were also made in cultivation activities of ‘IPR Celebrity Lecture’ and ‘IPR Shenzhen Forum’. In 2012, 56 sessions of IPR training sessions were organized for IPR management personnel, agencies and enterprise with more than 4,000 participants.

  2. IPR Talents Training Progressed Steadily

  Through close cooperation with the Human Resource and Social Security Bureau, professional title appraisal of IPR continued in 2012. 18 professionals obtained the title of IPR in total, among which 8 were awarded associated senior titles, 8 intermediate titles and 2 junior titles. Further progress was made in IPR Institute together with Shenzhen University with the goal to forge a special institute where IPR talents are cultivated. It can be talent support for Shenzhen IPR undertaking. 6 persons were selected as the member of the first batch of national IPR leading talents.

  3. International IPR Cooperation Intensified

  The municipal government continued to carry forward Shenzhen-Hong Kong cooperation in IPR. Delegations were sent to Hong Kong customs for study and communication, commenced IPR Joint Conference and explored the establishment of Shenzhen-Hong Kong IPR cooperation mechanism. Joint efforts were also made in propelling IPR protection and counterfeits crackdown. It received the visit of Business Guide-Sha and group led by Head of Japan Patent Office, IPR specialists from the British Embassy in China as well as officers of USTR; it communicated with IPR holders of TORY BURCH, Microsoft, SAP and Walt Disney; in addition, it also provided service of IPR protection with KFC, BYD, Mindray, Huawei, ZTE and Tencent etc..

  In summary, Shenzhen will implement innovative development and Shenzhen quality throughout economic and social development by centering on the theme of scientific development and economic transformation. The city will strive to develop strategic emerging industry and improve independent innovation capacity of core technologies. According to general requirement and deployment of national IPR strategy, it also requires further implementation of the strategy of a city strong in IPR and integrated resources. Great contributions will be made to develope national IPR undertaking and improving independent innovation capacity of Shenzhen by perfecting mechanism and policy measures and lifting IPR work level.
